This Privacy Policy establishes the bases on which ESPACIO DE MARCAS EMERGENTES, S.L. (EME), which acts under the trade name POPPYNS, with address at C / Isabel la Católica nº 21, 46004 Valencia (hereinafter, jointly "We" or "the Treatment Managers"), treats your personal data when you provide them to us during your experience through the website www.poppyns.com (hereinafter, "the Web").
Every time when using the Web you provide us or it is necessary for us to access any type of information that, due to its characteristics, allows us to identify you, such as your name and surname, e-mail, billing or shipping addresses, telephone number, card number debit or credit, etc. (hereinafter, "Personal Data"), whether to browse it, buy our products or use its services or functionalities, you will be subject to the application of this Privacy Policy, in force at all times. The ultimate purpose for which we collect your Personal Data is to facilitate and improve the service, which, as a customer, you expect from POPPYNS. Depending on the products, services or functionalities that you want to enjoy at all times, the necessary data are one or the other. We collect your personal information to manage your purchases, orders or requests that you make to us, either in our store or through the Web. Here are the main purposes we have identified:

- The affected party has exercised his right to oppose data processing, while verifying whether the legitimate reasons of the Data Controller prevail over the affected party.
2 — Responsible for the Treatment that keeps your Personal Data when:
- The data processing is illegal and the affected party opposes the deletion of their data and requests instead the limitation of its use.
- The Data Controller no longer needs the data for the purposes of the treatment, but the data subject does need them for the formulation, exercise or defense of claims.
— Right of opposition:
The affected person can oppose the treatment:

II — ¿CON QUÉ FINALIDAD TRATAMOS TUS DATOS PERSONALES?
La finalidad última por la que recabamos tus Datos Personales es para facilitar y mejorar el servicio, que, como cliente, esperas de POPPYNS. Dependiendo de los productos, servicios o funcionalidades de los que quieras disfrutar en cada momento, los datos necesarios son unos u otros. Recabamos tu información personal para gestionar tus compras, pedidos o solicitudes que nos realizas, bien sea en nuestra tienda o a través de la Web. A continuación, incluimos las principales finalidades que hemos identificado:

III — ¿CUÁL ES LA LEGITIMACIÓN PARA EL TRATAMIENTO DE TUS DATOS?
La base jurídica que nos legitima para el tratamiento de tus Datos Personales responde a diferentes motivos: en unos casos puede ser tu consentimiento, en otros el cumplimiento de una obligación legal, y en otros el interés legítimo.
La aportación de los datos solicitados es obligatoria por ser imprescindible para atender tu petición y/o prestar nuestros servicios. Si no los facilitas, no podremos llevar a cabo tu solicitud.
Cuando el tratamiento se base en tu consentimiento, el mismo se entenderá otorgado de forma clara e inequívoca.
IV — ¿POR CUÁNTO TIEMPO CONSERVAMOS TUS DATOS PERSONALES?
Solo almacenamos tus Datos Personales en la medida en que los necesitamos para la finalidad para la que fueron recabados, y según la base jurídica del tratamiento de los mismos de conformidad con la ley aplicable.
Mantendremos tu información personal mientras exista una relación contractual y/o comercial contigo, o mientras no ejerzas tu derecho de supresión, cancelación y/o limitación del tratamiento de la misma. En estos casos, mantendremos la información debidamente bloqueada, sin darle ningún uso, mientras pueda ser necesaria para el ejercicio o defensa de reclamaciones o pueda derivarse algún tipo de responsabilidad judicial, legal o contractual de su tratamiento, que deba ser atendida y para lo cual sea necesaria su recuperación. Una vez prescriban las posibles acciones en cada caso, procederemos a la supresión de tus Datos Personales.
V — ¿QUIÉNES PUEDEN SER CESIONARIOS O DESTINATARIOS DE TUS DATOS PERSONALES?
Los datos que nos proporcionas podrán ser comunicados a terceras entidades para el cumplimiento de las finalidades anteriormente descritas, así como a las entidades u organismos a los que así lo exija una obligación legal. Entre otros, pueden ser cedidos a:

VI — ¿CUÁLES SON TUS DERECHOS Y CÓMO PUEDES EJERCERLOS?
POPPYNS se compromete a respetar la confidencialidad de tus Datos Personales y a garantizarte el ejercicio de tus derechos. El Reglamento General de Protección de Datos regula los derechos de las personas afectadas ante un tratamiento de sus datos, especificando que, como titulares de los mismos, pueden ejercitar los siguientes derechos:
— Derecho de acceso:
La persona afectada tiene derecho a ser informada de:
- Los fines del tratamiento, categorías de Datos Personales que se traten y de las posibles comunicaciones de datos y sus destinatarios.
- De ser posible, el plazo de conservación de tus datos. De no serlo, los criterios para determinar este plazo.
- Del derecho a solicitar la rectificación o supresión de los datos, la limitación al tratamiento, u oponerse al mismo.
- Del derecho a presentar una reclamación ante la Autoridad de Control.
- Obtener una copia de los datos objeto del tratamiento.
- Si se produce una transferencia internacional de datos, recibir información de las garantías adecuadas.
- De la existencia de decisiones automatizadas (incluyendo perfiles), la lógica aplicada y consecuencias de este tratamiento.
— Derecho de rectificación:
La persona afectada tiene derecho a rectificar los datos inexactos, y a que se completen los Datos Personales incompletos, inclusive mediante una declaración adicional.
— Derecho de supresión (“Derecho al olvido”):
Con su ejercicio la persona afectada puede solicitar la supresión de los Datos Personales sin dilación debida cuando concurra alguno de los supuestos legalmente contemplados. Por ejemplo, tratamiento ilícito de datos, o cuando haya desaparecido la finalidad que motivó el tratamiento o recogida.
— Derecho a la limitación del tratamiento:
Permite a la persona afectada:
1 — Solicitar al Responsable del Tratamiento que suspenda el tratamiento de datos cuando:
- Se impugne la exactitud de los datos, mientras se verifica dicha exactitud por el responsable.
- El afectado ha ejercitado su derecho de oposición al tratamiento de datos, mientras se verifica si los motivos legítimos del Responsable del Tratamiento prevalecen sobre el afectadoSolicitar al
2 — Responsable del Tratamiento que conserve sus Datos Personales cuando:
- El tratamiento de datos sea ilícito y el afectado se oponga a la supresión de sus datos y solicite en su lugar la limitación de su uso.
- El Responsable del Tratamiento ya no necesita los datos para los fines del tratamiento, pero el afectado si los necesite para la formulación, ejercicio o defensa de reclamaciones.
— Derecho de oposición:
La persona afectada puede oponerse al tratamiento:
- Cuando por motivos relacionados con su situación personal, debe cesar el tratamiento de sus datos salvo que se acredite un interés legítimo, o sea necesario para el ejercicio o defensa de reclamaciones.
- Cuando el tratamiento tenga por objeto la mercadotecnia directa.
— Derecho a la portabilidad:
Cuando el tratamiento se efectúe por medios automatizados, en un formato estructurado, de uso común, de lectura mecánica e interoperable, puede solicitar que se transmitan a otro responsable del tratamiento, siempre que el tratamiento se legitime en base al consentimiento o en el marco de la ejecución de un contrato. No obstante, este derecho, por su propia naturaleza, no se puede aplicar cuando el tratamiento sea necesario para el cumplimiento de una misión de interés público o en el ejercicio de poderes públicos conferidos al Responsable del Tratamiento.
Para poder ejercer cualquiera de los derechos descritos anteriormente deberá cumplir con los siguientes requisitos:
- Presentación de un escrito debidamente firmado dirigido a ESPACIO DE MARCAS EMERGENTES, S.L., C/ Isabel la Católica nº 21, 46004 Valencia (Valencia-España), o al correo electrónico hello@poppyns.com
- El escrito remitido por el titular de los datos que solicite el ejercicio del derecho deberá de cumplir los siguientes requisitos legales:

- Nombre, apellidos del interesado y copia del DNI. En los excepcionales casos en que se admita la representación, será también necesaria la identificación por el mismo medio de la persona que le representa, así como el documento acreditativo de la representación. La fotocopia del DNI podrá ser sustituida siempre que se acredite la identidad por cualquier otro medio válido en Derecho.
- Petición en que se concreta la solicitud. (Derecho cuyo ejercicio se solicita o información a la que se quiere acceder). Si no hace referencia a un fichero concreto se le facilitará toda la información que se tenga con sus datos de carácter personal. Si solicita información de un fichero en concreto, solo se facilitará la información de este fichero. Si solicita información relativa a un tercero nunca se podrá facilitar. Si lo solicita por teléfono se le indicará que lo haga por escrito y se le informará de cómo lo puede hacer y la dirección a la que tiene que enviarlo. Nunca se dará información por teléfono.
- Domicilio a efecto de notificaciones.
- Fecha y firma del solicitante
- Documentos acreditativos de la petición que formula.
El interesado debe utilizar cualquier medio que permita acreditar el envío y la recepción de la solicitud.
